General terms and conditions for database use

 

1. Subject matter of the contract

The following conditions apply to all uses of the SCICOMED e.U. - hereinafter referred to as SCICOMED - under the address www.scicomed.net offered online database. The database contains scientific documentation sheets. The standardized structure of these documentation sheets serves, on the one hand, to enable the user to work in a time-efficient and cost-effective manner and, on the other hand, to support the transfer of data in the context of national and international scientific research projects. SCICOMED is an independent service provider and does not act on behalf of a user.

 

2. Contract, prices, right of withdrawal

The database usage contract between SCICOMED and the user comes about through payment and subsequent activation. The remuneration for the use of the database is based on the price list valid at the time of the conclusion of the contract. The invoice amount is due immediately upon receipt of the invoice and must be paid without deduction within 14 days. If the remuneration is not paid, SCICOMED reserves the right to block access until the remuneration has been paid in full. The user has the right to withdraw from the contract within two weeks of conclusion without giving any reason. The revocation can be made in writing, by email or by telephone. Timely dispatch is sufficient to meet the deadline: After receipt of the revocation, SCICOMED is obliged to reimburse the user for any payments already made. The right of withdrawal expires when the user first accesses the database.

 

3. SCICOMED services

Within the contract period, the user can access the database as often and as long as desired. SCICOMED undertakes to keep the database available at an annual average of 97.5%. No responsibility can be assumed for faults in lines and services that are beyond the control of SCICOMED or its contractual partners. In case of doubt, the contract period is extended by the period in which the services of the SCICOMED online database were not available to the user. There is no monetary compensation.

4. Copyrights

The SCICOMED online database and its contents are protected by copyright. The user undertakes to use the database only for private or internal use. SCICOMED is entitled to exclude users from using the database if it is suspected that it is being misused. A reduction in the contractual entitlement to remuneration is hereby excluded.

 

5. Contract term, termination

The contract is concluded for the duration selected in each case. An extension requires a new contract to be concluded. Both contracting parties have the right to terminate the database usage contract for an important reason without notice. An important reason exists in particular if one of the two contracting parties violates their contractual obligations and a continuation of the contractual relationship is therefore unreasonable. In the event of extraordinary termination for which SCICOMED is not responsible, the user will not receive any monetary compensation or repayment of a (partial) amount of the remuneration due to the shortening of the period of use. For the other billing periods, SCICOMED will send the user an invoice no later than the last day of the first month of the new billing period. The invoice amount is due immediately upon receipt of the invoice and must be paid without deduction within 14 days. In the event of non-payment, SCICOMED reserves the right to block access until payment has been received.

 

6. Liability and Compensation

The data set in the database is based on the information provided by the user. SCICOMED is not liable for incorrect information. SCICOMED accepts no liability for financial losses or losses, direct or indirect, that arise from the use or non-use of the information stored in the database.

 

7. Data protection

Your data is in safe hands with us. Scicomed is committed to protecting your data and takes this mission seriously. This data protection information describes why and how we collect data and in what form we process it.

7.2. Personal data

Personal data of our business partners within the meaning of the GDPR is information that relates to persons whose identity can be identified (e.g. name, contact details, email address, IP address).

We process your personal data

  • to safeguard our legitimate interests, namely ensuring the operation, security and optimization of our website
  • To process your inquiries that you put to us via the contact form or other inquiry forms on our website, by email or by telephone

We use SSL encryption to be able to transmit your data securely. Our website and mail server are hosted by the German host “Host Europe GmbH”. The processing takes place in accordance with the currently valid data protection regulations.

 

7.4. Cookies

Our website uses so-called cookies. These are small text files that are stored on your device with the help of the browser. They do no harm. We use cookies to make our offer user-friendly. Some cookies remain stored on your device until you delete them. They enable us to recognize your browser the next time you visit. 7.5. Data processing

  • to carry out pre-contractual measures (e.g. test account) or to fulfill our contractual obligations within the framework of the contractual relationship,

The following data is processed within the scope of the order and use: Name, address, telephone and fax number, email address, username, password, time and IP address of successful and failed logins, last access

All messages you send to Scicomed or the information they contain will be used solely for the purpose of answering your request. Scicomed does not pass on your personal data to third parties, unless you are required to process business transactions. In such a case, the transmitted data will be reduced to the necessary minimum. Insofar as Scicomed is obliged to do so by law or by court order, we will only pass on your data to state institutions and authorities entitled to receive information. All employees are contractually obliged to maintain data secrecy in accordance with the Data Protection Act.

 

7.6. Note on external links

There may be links to other websites on our website. Scicomed is not responsible for the design or the content. The links are regularly checked for illegal content and removed immediately if necessary.

 

7.7. Right to information, correction and deletion

In principle, you have the right to information, correction, deletion, restriction, data portability, revocation and objection. If you believe that the processing of your data violates data protection law or that your data protection claims have been violated in any other way, you can complain to the supervisory authority. In Austria this is the data protection authority.

8. User Obligations

The user undertakes not to pass on access data (login and password) to third parties and to take measures that exclude direct or indirect use by third parties. The user is liable for any misuse of his password if he is responsible for the misuse. In this case, SCICOMED is entitled to extraordinary termination without notice. The user is responsible for acquiring and setting up the technical requirements for his access and transmission options.

 

9. Final provisions

In the event of disputes between the user and SCICOMED, ​​Austrian law applies exclusively. Subsidiary agreements, changes or additions to this contract must be made in writing to be effective. The cancellation of the written form requirement must also be in writing to be effective. The place of performance and jurisdiction for disputes arising from or in connection with this contract is, as far as legally permissible, Vienna for both parties.
